Teens plead not guilty to robbery

Two teenagers accused of robbing a gas station pleaded not guilty Wednesday in Lawrence County Common Pleas Court.

Shawn A. Morrison, 18, of 414 County Road 54, Kitts Hill, pleaded not guilty in front of Judge Charles Cooper to first-degree aggravated robbery and third-degree tampering with evidence.

He passed a drug screening, the judge said.

Morrison, along with co-defendant Jonathan Lyons, is accused of robbing the BP off U.S. 52 at Charlie Creek Road, Lawrence County Assistant Prosecutor Jeff Smith said.

Cooper continued bond from a lower court and scheduled a pretrial hearing for Sept. 21.

Lyons, 19, of 103 Bowman St., Coal Grove, pleaded not guilty to first-degree complicity to aggravated robbery and third-degree tampering with evidence.

Lyons tested positive for marijuana, Lynn Stewart, probation officer, said. Cooper set bond at $75,000 cash or surety or $150,000 property and scheduled a pretrial hearing for Wednesday.

The two, as well as others in court Wednesday, were drug tested in keeping with a new policy in Cooper’s courtroom.

The judge is requiring all defendants who are on bond to be drug tested on the day of court hearings. Cooper said eight of the 11 defendants tested Wednesday were positive for drugs. Some may present prescriptions, the judge added.

In other cases:

Natasha D. Strunk, 24, of 265 County Road 45, Ironton, pleaded not guilty to fifth-degree aggravated drug possession and misdemeanor endangering children. She tested positive for benzodiazepine and Oxycontin, Assistant Prosecutor Jeff Smith said.

Strunk told Cooper that she has a prescription for the drugs.

The judge allowed the woman to sign her own bond for $50,000 but required that she come to the court today to show officials the prescriptions for the drugs.

A pretrial hearing is set for Sept. 21.

Adam Bare, 22, of 2827 S. Ninth St., Ironton, pleaded not guilty to three counts of fourth-degree assault. Bare tested positive for Oxycontin, court officials said. His attorney, Mike Gleichauf told the court his client does not have a prescription for the medication.

Cooper set bond at $25,000 cash or surety.

Amanda Debraga, 25, of 6028 Hubbards Branch Road, Huntington, W.Va., pleaded guilty to fifth-degree misuse of a credit card and two counts of fifth-degree forgery.

Cooper sentenced Debraga to four years of community-control sanctions.

A total of 22 months in prison have been reserved for Debraga in the event she violates the terms of CCS.

One condition of her CCS will be to attend a program at the Athens Rural Women’s Recovery Program.

Debraga passed a drug screening, Smith said.

Kathy Swed, 43, of 186 Township Road 181, Ironton, pleaded not guilty to two counts of fifth-degree passing bad checks and one count of fifth-degree unauthorized use of a vehicle.

Swed tested positive for benzodiazepine, Smith said.

Her attorney, Warren Morford told the court that Swed had a prescription for two drugs and that he does not know if those medications contain benzodiazepine.

Cooper continued bond at least until Monday when Swed is required to present her prescriptions to the court.

Jeremy S. Stump, 31, of 99 Pritchard St., Proctorville, pleaded not guilty to fourth-degree receiving stolen property.

Stump tested positive for Oxycontin, the judge said. Cooper set bond at $10,000 cash or surety or $20,000 property and scheduled a pretrial hearing for Sept. 21.

John D. Large, 40, of 52 Township Road 338, Ironton, pleaded not guilty to breaking and entering. Large did not pass a drug screening, Assistant Prosecutor Brigham Anderson said.

Large’s attorney, Derek Fisher, told the court his client checked himself into drug treatment. Cooper set bond at $7,500 cash or surety and scheduled a pretrial hearing for Sept. 21.

Thomas C. Petty, 29, of 905 Gary Malone St. Lot 9, South Point, pleaded not guilty to failure to provide a change of address. Petty was convicted of gross sexual imposition in 2009. Cooper transferred bond from a lower court and scheduled a pretrial hearing for Sept. 21.

Jason Newcomb, 29, of 2065 B. County Road 22, Ironton, pleaded guilty to fifth-degree theft. Cooper sentenced Newcomb to six months in prison.

Jonathan Rice, 23, of 2434 ½ S. Sixth St., Ironton, admitted to violating the terms of his CCS. Cooper sentenced Rice to just under one year, the remaining balance of the sentence that had been reserved for him.
