Chesapeake man denies B&E charges

A Chesapeake man accused of breaking into several businesses in the Rome Township area answered the charges against him Wednesday in Lawrence County Common Pleas Court.

Bryan K. Shaffer, 44, of 764 County Road 3, was arraigned on and pleaded not guilty to seven counts of fifth-degree breaking and entering, a fourth-degree count of theft and two counts of third-degree tampering with evidence.

Judge Charles Cooper set bond at $75,000 cash or surety and a pretrial was set for March 18.

Among the businesses Shaffer is accused of breaking into are Rome Tire & Brake, Hamilton Chevrolet, Carey Chiropractic, C&R Nail and Hair Salon, Chesapeake Krispy Chicken, Legacy Dental Center and Iron Valley Landfill.

In other cases, a husband and wife were arraigned on multiple counts of drug charges.

James Martin, 39, and Stephanie Martin, 42, both of 20 Township Road 1039 Apt. 9, Chesapeake, pleaded not guilty.

James Martin is charged with two fifth-, one fourth- and one first-degree count of trafficking in heroin, a fourth-degree count of trafficking in drugs, a fourth-degree count of trafficking in marijuana and a count of having weapons under a disability.

Stephanie Martin is charged with a fifth-degree count of trafficking in heroin, a first-degree count of complicity to trafficking in heroin and fourth-degree counts of complicity to trafficking in drugs and complicity to trafficking in marijuana.

Cooper set bond for each at $100,000 cash or surety and pretrials were set for March 18.

Other defendants who made court appearances were:

• Brandi Roberts, 24, of 301 Second Ave., Chesapeake, was sentenced to four years community control sanctions under intensive supervised probation, STAR, a $1,250 fine and a six-month driver’s license suspension. She previously pleaded guilty to two fifth-degree counts of possession of drugs and a third-degree count of tampering with evidence.

• Franklin Hall, 36, of 167 Jefferson St., Franklin Furnace, was arraigned on and pleaded not guilty to a second-degree count of felonious assault. Cooper set bond at $75,000 cash or surety and a pretrial was set for March 18.

• Jerry Berry, 45, of 266 County Road 54, Kitts Hill, was arraigned on a bill of information of third-degree DUI, to which he pleaded guilty.

Cooper sentenced the man to 18 months in prison, a $5,000 fine and a five-year driver’s license suspension.

• Joshua Harless, 31, of 1176 County Road 104, Chesapeake, pleaded guilty to a fifth-degree count of failure to notify change of address. Cooper ordered a presentence investigation and set sentencing for March 18.

• Ellen Yoder, 27, of 153 Private Drive 4374 State Route 217, Willow Wood, was sentenced to STAR. She previously admitted CCS violations.

• Sierra Hern, 19, of 401 Marion Pike, Coal Grove, was arraigned on and pleaded not guilty to two third-degree counts of trafficking in drugs in the vicinity of a school (Alpha PVP). Cooper set bond at $25,000 cash or surety and a pretrial for March 18.

• Buddy Jenkins, 34, of 615 S. Fifth St., Ironton, admitted CCS violations and was sentenced to five months in prison.

• Dara Rowe, 36, of 13 Private Drive 372, Ironton, pleaded guilty to third-degree tampering with evidence and fifth-degree possession of drugs. Cooper set sentencing for March 11.

• Brian Gibson, 41, of 644 Limestone Branch, Salyersville, Kentucky, was arraigned on and pleaded not guilty to s fifth-degree count of identity fraud and a misdemeanor count of resisting arrest.

Judge D. Scott Bowling set bond at $7,000 cash or surety and $10,000 own-recognizance plus GPS monitoring. A pretrial was set for March 18.

• Joseph L. Whitmore, 35, of South Point, was arraigned on and pleaded not guilty to a third-degree count of tampering with evidence, fifth-degree possession of heroin and fifth-degree possession of cocaine.

Bowling set bond at $30,000 cash or surety and OR. A pretrial was set for March 25.

• Dustin Boyd, 30, listed as homeless, was sentenced to four years CCS/ISP, STAR, 200 hours community service and a $1,250 fine for counts of fifth-degree possession of drugs and failure to appear.
