Trial date set in bike civil rights case

CHESAPEAKE — If a civil rights lawsuit against various county law enforcement agencies is not settled out of court, it will take 18 months before a jury gets to weigh in.
That’s when the suit of Anthony Patrick will come to trial before Judge Michael Bennett in U.S. District Court, Western Division, in Cincinnati.
In August 2009, a suit was filed by Patrick, a Huntington, W.Va.-based construction firm owner, charging his civil rights were violated when he was Tasered and arrested in the village of Chesapeake one year earlier.
Patrick and a juvenile were biking through Chesapeake as part of an endurance ride through Lawrence County before returning to Huntington. As they came through Chesapeake, they contend they were stopped and Tasered by Lawrence County Sheriff’s deputy Charles Hammonds and Dennis Gibson, then a village patrolmen and now Chesapeake Police Chief.
Patrick, then 37, was arrested and taken to Lawrence County Jail where he was charged with obstructing official business, resisting arrest, attempted assault on a police officer and operating a bike on the road.
A year after the incident Patrick filed a lawsuit in U.S. District Court naming current Lawrence County Sheriff Jeff Lawless, Hammonds, then Chesapeake Police Chief Russell Bennett and the village as defendants.
The trial is set for July 18, 2011.

Mr. Patrick has an EXTREME ATTITUDE (as do most other byciclists) that think THEY OWN THE ROAD..
When in truth they must yield to traffic and not ride in the middle of the road as these two were doing.
They were NOT riding along the right side of the lane, They were actually blocking traffic while riding abreast
of each other.
Then their 'Attitudes' when confronted... They act like
those idiots from PETA... (who should be known as People Eating Tasty Animals)
Oh yeah... 'EAT A BEAN...or two'

bicycle riders on public streets have the same rights and responsibilities as automobile drivers...unless these riders were breaking some traffic law, the officers had no right to approach them...no doubt, the automobile driver or drivers who complained about these cyclists has at some time or other gone over the speed limit on this street and gone unnoticed...I'm afraid the CPD is going to lose this one...would you rather your child be struck by a speeding car?

HERE WE AGAIN....I AGREE WITH YOU TIGER 99% OF THEM THINK THEY OWN THE ROAD I KNOW MR.GIBSON HE IS A GREAT PERSON AND CHIEF. I WORKED AT GIOVANNIS FOR SIX YEARS AND I WASENT WORRIED AS LONG AS I KNEW DENNIS WAS A CALL AWAY.AND WE ARE NOT TALKING ABOUT KIDS ON BICYCLES WE ARE TALKING ABOUT ADULTS. I HOPE CPD KICK'S HIS A**!!!!

the sheriff's office will taser you for fun, ihave seen first hand inside the jail, when a naked guy was laying on his stomach handcuffed and they tasered him in the a** and the cops stood around laughing with the IPD.

And we all know that there are no bad cops anywhere, they all are fine, upstanding citizens, who would never do anything wrong. Please Jenny, give me a break. And no, I have never been arrested, been in trouble of any kind, but I know cops who are nothing but trash, not all, but like any profession they have their share of ***holes too.

jenny i know they have rights as well but this dude is looking for big bucks,and i dident say they were all bad but most of them are rude!THEY SHOULD HAVE TO MANTAIN A CERTIN SPEED OR GET OUT OF THE WAY!
