Sheriff: Child allegedly abused #039;doing better#039;

A Chesapeake, child, hospitalized for injuries resulting from suspected child abuse, is "doing better," Lawrence County Sheriff Tim Sexton said Monday.

"We knew people were offering their prayers and we appreciate that," Sexton said. "He has steadily improved."

Meanwhile the child's mother, Dianna Miller, 31, and a friend, Thomas Overby, 32, who both reside at 204 Rockwood Ave., will return to

Lawrence County Municipal Court Friday for preliminary hearings in connection with the alleged abuse.

The two adults were arrested last Thursday by Lawrence County sheriff's deputies after medical personnel alerted authorities to the child's injuries. Miller and Overby were arraigned in municipal court Friday. Miller is charged with second-degree felony child endangering while Overby is charged with second-degree felonious assault.

Lawrence County Municipal Court Judge Donald Capper set bond at $100,000 each. Both remain in the Lawrence County Jail.

Sexton said late last week he expects additional charges will be filed in the case. Three other children at that residence are now in the care of Lawrence County Children's Services.
