Bank case pleas are changed

Two men who allegedly broke into an Ironton bank were ordered to undergo mental evaluations following their change of plea Wednesday in Lawrence County Common Pleas Court.

Austin Sexton, 20, and Richard Fooce, 22, with addresses at Fout’s Personal Care Facility in Ironton, each pleaded not guilty by reason of insanity. The pair were in separate courtrooms for the change of plea.

Both men are charged with a fifth-degree count of breaking and entering following their arrest last month. They are accused of breaking into the WesBanco branch on South Fifth and Vernon streets in Ironton.

In other cases:

• John Kinney, 26, of 603 Buckhorn St., Ironton, was arraigned on counts of second-degree aggravated vehicular assault, fourth-degree DUI and misdemeanor driving under suspension, to which he pleaded not guilty.

Judge Charles Cooper set bond at $10,000 own-recognizance plus GPS monitoring. A pretrial was set for Sept. 23.

• Jason Collier, 30, of 48 Private Drive 2600, Chesapeake, was sentenced to four years community control sanctions under intensive supervised probation and STAR. He previously pleaded guilty to a fourth-degree count of theft of drugs.

• Herbert Delawder, 37, of 109 Lane St., Coal Grove, was arraigned on a third-degree count of aggravated trafficking in drugs, to which he pleaded not guilty. Cooper set bond at $5,000 cash or surety and a pretrial was set for Sept. 23.

• Tracy McDonald, 45, of 19 Township Road 31, Chesapeake, was sentenced to four years in prison for counts of second-degree felonious assault, misdemeanor assault and fourth-degree assault on a peace office, to which he previously pleaded guilty.

• Cindy Gannon, 36, of 480 County Road 7C, Ironton, admitted CCS violations and was sentenced to seven months in prison.

• Mark Besinger, 56, of 1808 S. Eighth St., Ironton, was sentenced to four years CCS/ISP and STAR for two fifth-degree counts of theft to which he previously pleaded guilty.
