Defendant in pain clinic case getting probation

Would have testified against doctor

A second man who worked at a former Ironton pain clinic was sentenced Wednesday in Lawrence County Common Pleas Court.

Kevin Bowers, 45, of Lancaster, pleaded guilty in December to amended indictment of fourth-degree engaging in a pattern of corrupt activity and fifth degree of practicing osteopathy without a certificate.

Matthew Donahue, from the Ohio Attorney General’s Office, recommended Bowers be sentenced to probation considering his cooperation during the case.

“He was ready to testify if the case had gone to trial,” Donahue said.

Rick Faulkner, attorney for Bowers, agreed to the recommendation, saying Bowers “has fully cooperated and done what was asked of him.”

Judge Charles Cooper sentenced Bowers to three years community control sanctions under intensive supervised probation. He was also ordered to pay a $5,000 fine. If he violates his probation, he could be sentenced to prison for up to 18 months.

“I’m very sorry for my lack of judgment, that caused this to arise,” Bowers said.

Bowers was charged in 2013 following an investigation of the Pinnacle Wellness and Longevity Center LLC, on South Third Street. Also charged was Adam Hall, of Powell, who received the same sentence last week for an amended indictment of fifth-degree possession of criminal tools and fourth degree attempted tampering with evidence.

In other cases:

• Kurt Chastain, 21, of 1116 County Road 123, Chesapeake, pleaded guilty to a third-degree count of gross sexual imposition. Cooper sentenced the man to four years in prison. Chastain must register as a Tier II sex offender for 25 years.

• Tina Carman, 51, of 229 Township Road 1080 Waterloo, was sentenced to two years in prison for a third-degree count of illegal conveyance of drugs into a detention facility, for which she previously pleaded guilty.

• Todd McCann, 42, of 657 County Road 119, Ironton, tested positive for benzodiazepines at his pretrial drug screening. This was his second failed drug test while out on bond, according to the court. Cooper increased the man’s bond to $250,000 cash or surety and $100,000 own-recognizance.

• Christopher Douglas, 31, of New Boston, admitted CCS violations and was sentenced to nine months in prison.

• Martin Payne, 29, of 3789 Redmond Ridge Road, Gallipolis Ferry, West Virginia, pleaded guilty to a second-degree count of burglary. Cooper sentenced the man to three years in prison.

• Frederick Martin, 43, of 8250 County Road 1, South Point, was arraigned on a first-degree count of rape, to which he pleaded not guilty. Bond was set at $60,000 property and $100,000 OR with GPS monitoring. A pretrial was set for March 30.

• Paul J. Waginger, 28, of 486 Pittsfield Drive, Worthington, admitted CCS violations and was given credit for time served.

• Christopher Hale, 27, of 729 Panhandle Ave., West Union, admitted CCS violations and was sentenced to six months in prison.
