A Proctorville man faces at least seven years in prison on a rape charge because of probation violations, Lawrence County prosecutor J.B. Collier Jr. said.

The sentence was one of four handed down by Lawrence County Common Pleas Court judges Wednesday, Collier said.

Tracy Damron, 38, of Proctorville, entered an admission Feb. 16 that he had violated requirements set by the court in 1996 when it sentenced him to five years probation.

Common Pleas Court Judge Richard Walton ordered Damron to seek a specialized treatment program or face his original sentence – not less than seven nor more than 25 years in prison for first-degree rape.

Damron did not qualify for the treatment program, so the original charge was reinstated Wednesday, according to court records.

Also in court Wednesday:

– Darrell Jayne, 36, formerly of Ironton: Pleaded guilty to two counts criminal non-support, fifth-degree felonies. Jayne was ordered to pay regular child support of $100 per month plus an additional amount on his back payments to be determined by the county’s Bureau of Community Corrections.

Jayne was given credit for 26 days jail time served and ordered to pay court costs.

– Mark A. Duncan, 33, of 2666 James River Road, Huntington, W.Va.: Pleaded guilty to deception to obtain dangerous drugs, a fifth-degree felony.

Judge Frank McCown sentenced Duncan to three years community control sanctions under intensive supervised probation, including six months in the in-house Salvation Army treatment program in Cincinnati.

– Charlie R. Baker, 36, of Oil Springs, Ky.: Pleaded guilty to illegal processing of drug documents, a fifth-degree felony, and possession of drugs, a third-degree misdemeanor.

Judge McCown sentenced Baker to three years community control sanctions, including 60 days in the county jail on each count to be served at the same time. He also was given credit for 15 days served.
