The mother of an Ironton woman who was killed

years two ago in an accident on the Ironton floodwall has filed a lawsuit against the woman who pleaded guilty to killing her daughter and the man who owned the car that was used.

Betty Thompson, of Ironton, mother of Kathleen Owens, filed her lawsuit Monday against Kimberly Delawder, also of Ironton, and Joseph Krantz, whose is listed in court documents as a Flatwoods, Ky., resident.

In the lawsuit, Thompson seeks “an amount in excess of $25,000” jointly and severally against the two, as well as punitive damages, legal fees and other costs.

Thompson contends Owens’ death “was directly and proximately caused by defendant Kimberly Delawders’ negligence,”

that Delawder was under the influence of drugs or alcohol while she was driving that night and that as a result of Delawder’s actions, Thompson and other members of Owens’ family have suffered loss of society, inheritance and mental anguish.

In addition to her mother, Owens is survived by her father, her husband, Orlando Owens and three children.

The lawsuit also contends Krantz allowed Delawder to drive his car.

Owen’s body was found on the floodwall along Second Street near the Buckeye Barn in September 2005.

Delawder was arrested a few days later in Myrtle Beach, S.C.In March 2006, she was sentenced to four years in prison after pleading guilty to vehicular homicide and is incarcerated at the Ohio Reformatory for Women in Marysville.
