Not showing up in court for your drug trial has consequences, a Michigan man learned Wednesday.

James M. Daniel, 29, of Wayne, Mich., was arraigned Wednesday in Lawrence County Common Pleas Court on a charge of failure to appear after he and one of two co-defendants did not show up for trial in October.

Judge D. Scott Bowling set bond at $500,000 cash and re-set Daniel’s trial for Jan. 29 during Wednesday’s court proceedings. A pretrial conference was scheduled Jan. 14.

Daniel, Eugene Walmsley, 27, of St. Inkster, Mich, and Chartese Love, 24, of Huntington, W.Va., were all arrested by Ohio State Highway Patrol troopers in October 2007 following a traffic stop.

They were first indicted on crack cocaine charges until tests confirmed the substance was actually powder cocaine.

All three were scheduled to be tried together in October 2008. Love did show up and pleaded guilty to the charges against her but Daniel and Walmsley did not show up and warrants were issued for their arrests.

Daniel was apprehended Dec. 28 in Huntington, W.Va. Walmsley remains at large. Daniel remains in the Lawrence County Jail.
