Open dumping trial to start next week

SOUTH POINT — A new trial date has been set in the open dumping case of the owner of a South Point cemetery.

The case against Larry Carter, owner of Highland Memorial Gardens in South Point, has been set to be heard in the court of Lawrence County Common Pleas D. Scott Bowling starting on March 25 and 26. The trial had originally been scheduled for March 8.

Carter was indicted in September by a Lawrence County Grand Jury after a criminal affidavit was filed this spring by Steve Hileman of the Lawrence-Scioto Solid Waste District.

In that document Hileman said Carter “did knowingly dispose of solid waste (plastic flowers) and other miscellaneous debris by throwing over the east hillside off 198 Pvt Rd. 1336 (Highland Memorial) in violation of the ORC 3734.03 Opening Dumping.

This is the second time in five years authorities have accused Carter of open dumping in connection with the cemetery.
