Drug, burglary charges heard in court

A South Point man will spend four years in jail for drug charges.

Dale Gene McCoy, 56, of 9916 State Route 243, South Point, pleaded guilty Wednesday in Lawrence County Common Pleas Court to five counts of second and third-degree aggravated trafficking in drugs.

Judge Charles Cooper sentenced McCoy to four years in prison on each count to run concurrently for a total of four years. McCoy was also ordered to pay mandatory fines.

Also in court Wednesday, Joshua Schwab, 25, of 120 Freeman Court, Apt. 3, South Point, pleaded guilty to second-degree burglary.

Cooper sentenced Schwab to four years in prison and ordered him to pay $3,350 in restitution to the victim. The judge denied Schwab’s request for a furlough but granted a courtroom visit with his family.

In other cases:

Gary Bruce Thompson Jr., 35, of 901 S. Seventh St., Ironton, pleaded not guilty to grand theft, receiving stolen property, breaking and entering and vandalism. Thompson, along with co-defendant Rickey E. Winters, 51, of 417 Solida Road, South Point, is accused of breaking into the Tackle Box in South Point.

Thompson recently turned himself in, his defense attorney Mike Davenport said.

Judge Charles Cooper set bond at $50,000 cash or surety plus $85,000 property and scheduled a pretrial-hearing for July 13.

Bradley Harper, 35, of 414 Little Solida Road, South Point, pleaded guilty to three counts of misdemeanor criminal nonsupport.

In exchange for a guilty plea to the misdemeanor charges, Lawrence County Assistant Prosecutor Brigham Anderson dropped three counts of felony criminal nonsupport and recommended a suspended 180-day jail sentence and three years of probation.

Cooper sentenced Harper to the recommended sentence. Harper was also ordered to pay $1,800 Wednesday and an additional $1,000 each month towards the approximately $25,000 that he owes for child support.

Joshua M. Rice, 27, of 3107 Powell St., Ironton, pleaded guilty to breaking and entering for breaking into a church.

Cooper sentenced Rice to six months in prison. As a part of his plea bargain, Rice also agreed to testify truthfully against a co-defendant in the case, Anderson said.

Ralph E. Branam, 38, of 129 County Road 45, Ironton, pleaded guilty to two counts of misdemeanor criminal nonsupport.

In an exchange for a guilty plea to the misdemeanor charges, prosecutors dropped two counts of felony criminal nonsupport.

Cooper sentenced Branam to a suspended sentence of 180 days in jail and three years of probation. Branam was also ordered to pay $100 per month toward the approximately $19,300 he owes for child support.

Charles B. Burton Jr., 39, of 214 Park Circle, Huntington, W.Va., admitted violating the terms of his community-control sanctions by failing to pay child support.

Cooper extended Burton’s CCS one year and ordered that he would do community service work every day until he gains employment and is able to make payments toward child support.
