Domestic violence shooting sends one to hospital

No arrests concerning case made, investigation ongoing

At about 11:35 p.m. Sunday, June 18, 2017, the Lawrence County Sheriff’s Office received a call for assistance concerning a domestic violence situation and possible shooting at 395 Township Road 2785 in Chesapeake.

Upon the deputies’ arrival, they discovered that Daniel Lyons, 25, of 335 Township Road 2785, Chesapeake, had been shot twice in the abdomen with a small caliber handgun. Lyons was transported to St. Mary’s Medical Center, Huntington, West Virginia, by Lawrence County EMS. It is believed that his wound is not life threatening.

Detectives investigating this incident have discovered that Lyons got into an argument with Bran Potter, 49, of the same residence as Lyons, over a plumbing issue. Lyons is the live-in boyfriend of Potter’s daughter. The argument escalated into a fight and Potter discharged a small caliber handgun, which struck Lyons in the abdomen.

This incident is in the early stages of investigation and no arrests concerning this incident have been made at this time. However, Potter was arrested on an outstanding Failure to Appear warrant for a traffic violation unrelated to this case.

Lawrence County Sheriff Jeff Lawless said that Lyons had undergone successful surgery on Monday, and that detectives were waiting to meet with him for questions.

Lawless also added that Potter claimed the shooting to be self-defense, but once the sheriff’s office had all of the facts of the case, it would present it to the prosecutor’s office for them to make a final determination.

The investigation into this incident is ongoing.
