Mental competency will be evaluated

 

A Cincinnati man who allegedly assaulted a woman after asking to use her phone will be evaluated for competency based on his plea Wednesday in Lawrence County Common Pleas Court.

Robert Eldred, 29, of 6634 Cambridge Ave., was arraigned on a first-degree count of aggravated burglary, to which he pleaded not guilty and not guilty by reason of insanity.

Assistant Prosecuting Attorney Mike Gleichauf asked for a $50,000 cash or surety bond to be set, as well as $50,000 own-recognizance.

Eldred’s attorney, Philip Heald, asked that his bond be continued from the lower court since the man had no prior criminal record and had a “break of mental health,” which led to the alleged incident.

Heald said Eldred was now under the care of a physician and on medication.

Cooper set bond at $50,000 and set a pretrial for March 25.

Eldred was arrested on Dec. 8 after allegedly attacking a woman in her home in Chesapeake.

According to sheriff’s reports, Eldred was in town visiting family and “claimed he had not slept for a couple of days and that an altercation had taken place, at which point he fled the residence and arrived at a house unknown to him and asked to use the phone.”

The homeowner allowed Eldred to use the phone and the man left the residence. He later allegedly returned to the home and entered without permission and struck the woman in the face, causing a laceration.

In other cases:

• Savannah Jenkins, 27, of 95 Private Drive 3093, Ironton, admitted community control sanctions violations and was sentenced to four months in prison.

• Barry Woods, 44, of 1214 S. Fifth St., Ironton, admitted CCS violations and was sentenced to 18 months in prison.

• Tabitha Horsley, 26, of 94 Township Road 616 Apt. A, South Point, was arraigned on counts of fifth-degree theft from the Proctorville Fire Department and fifth-degree receiving stolen property, to which she pleaded not guilty.

Cooper set bond at $30,000 cash or surety and $30,000 OR. A pretrial was set for March 35.

• Justin Layman, 29, of 2226 State Route 378, Chesapeake, admitted CCS violations and was sentenced to two years in prison.

• Dara Rowe, 36, of 13 Township Road 373, Ironton, was sentenced to four years CCS under intensive supervised probation, STAR, a $1,250 fine and a six-month driver’s license suspension. She previously pleaded guilty to tampering with evidence and possession of drugs.

• Delane Rowe, 34, of 521 N. Fourth St., Ironton, pleaded guilty to two fifth-degree counts of criminal nonsupport. Cooper sentenced the man to six months in prison.
