Pretrials continued in trafficking cases

Defendant sentenced to seven years for burglary

James E. “Cuz” Harrell, 46, of Ironton, Antonio Smith, 46, of Detroit, Michigan, and Carlos D. Smith, 43, of Ironton had their cases continued in Judge Charles Cooper’s court on Wednesday.

Harrell has been indicted on nine counts related to trafficking in Oxycodone, including four counts of F3 trafficking in drugs and five counts of F1 aggravated trafficking in drugs. Antonio Smith was indicted on 13 counts, including trafficking, complicity to trafficking with Harrell, aggravated trafficking and engaging in a pattern of corrupt behavior. Carlos Smith has also been indicted on nine related counts, including five counts of aggravated trafficking, three counts of trafficking, and one count of engaging in a pattern of corrupt behavior. Carlos Smith’s case was delayed after he tested positive for marijuana. He had his bond increased to $500,000 cash surety and had his pretrial set for March 21.

Lowell Ratliff, 35, of Ironton, Destiny C. Rickey, 21, of South Point, Anneimika Walters, age and address unknown, Robert L. Williams III, 58, of Ironton, and Gregory B. Loudenback, age and address unknown, also had their cases continued.

Samuel J. Patrick, 20, of Proctorville denied his CCS violation and had his trial set for March 15.

Ryan Fuller, 21, of Proctorville, had his evaluation admitted into the record and his defense team asked for a second evaluation. Fuller’s previous evaluation stated that he was competent to stand trial for a 2015 felonious assault charge.

Robert Duty, age and address unknown, had the status of his case evaluated after withdrawing his previous negotiated guilty plea and had his original charges reinstated.
Duty is charged with five counts, including three counts of trafficking in heroin, one count of trafficking in cocaine, and one count of trafficking in drugs. His motion stated that his guilty plea “was not knowingly, voluntarily, or intelligently made.” His pretrial was set for March 15.

Maurice Cooper, 39, of Farrell , PA, tested positive for marijuana and had his trial rescheduled for March 10, and his cash surety bond increased from $80,000 to $120,000. Cooper is charged with five counts, including trafficking in cocaine, possession of cocaine, having weapons under disability, possession of criminal tools, and trafficking in drugs.

In Judge Andrew Ballard’s courtroom Nicole Boles, 34, of Ironton, was sentenced to four years of community control sanctions with intensive supervised probation, and ordered to complete a program at STAR and to complete 200 hours of community service.

Evelyn Caplinger, 44, of Ironton, was sentenced to six months in prison on a CCS violation for failing to report to STAR.

Elizabeth Walker, 20, of South Point, was also sentenced to six months in prison on a CCS violation for forgery.

Wendi Johnson, 40, of Kenova, denied her CCS violation and had her trial set for March 8.

Troy Hughes, 27, of Coal Grove, pleaded guilty to misuse of a credit card and was ordered to report to treatment at Riverside Treatment Center.

Terren Jenkins, 25, of Ironton, was given four years of CCS with ISP and ordered to complete a program at STAR after entering a guilty plea in a domestic violence case.

Anthony Jones, 27, of Huntington, had his theft case continued.

Brandon L McFann, 32, of Pedro, was sentenced to 200 hours of community service, four years of CCS with ISP, and remanded to a program at the V.A. in Chillicothe on a count each of trafficking and complicity to trafficking. McFann will also have to wear a GPS monitor until released to the program.

Tyler Ruggles, 27, of South Point, was sentenced to seven years in prison on two counts of burglary F2.

Donald A. Skaggs, 50, of Ironton, had his trial set for March 8 on a domestic violence charge, with bond set at $50,000 own recognizances.

Jennifer Flora, 25, of Huntington, denied her CCS violation and had her trial set for March 8. Flora is accused of failing to appear for her CCS meeting with her probation officer.
